A grand jury in Staten Island, New York voted today that there was not enough evidence to indict New York City police officer Daniel Pantaleo, who was administering a chokehold to Garner in July when he died as police arrested him. US Attorney General Eric Holder asked protesters to be peaceful and launched a federal probe into the choking death of an unarmed African American who was being restrained by police. Holder said that Eric Garner, who was 43, ‘died tragically’ at the hands of police, and that federal investigators would conduct an ‘independent, thorough and fair’ investigation to see if his civil rights had been violated. The federal probe will follow the refusal of a grand jury to indict the police officer who restrained Garner. Holder said that Garner’s death in July, along with the shooting death of an unarmed African American Michael Brown by a white policeman in Ferguson, Missouri, in August ‘have tested the sense of trust between law enforcement and the community they are charged to protect.’ EPA/ERIK LESSER
